AITpro Software Products License
This agreement applies to the following:
1. AITpro software, which means the AITpro software product that licensee has acquired.
2. The AITpro software listed below is licensed under the following terms and conditions.
AITpro software: BulletProof Security Pro
Section 1 – General Terms
BY DOWNLOADING, INSTALLING, COPYING, ACCESSING, OR USING BulletProof Security Pro YOU AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU ARE ACCEPTING THESE TERMS ON BEHALF OF ANOTHER PERSON OR A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE FULL AUTHORITY TO BIND THAT PERSON, COMPANY, OR LEGAL ENTITY TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS,
* DO NOT DOWNLOAD, INSTALL, COPY, ACCESS, OR USE BulletProof Security Pro; AND
* PROMPTLY RETURN BulletProof Security Pro TO THE PARTY FROM WHOM YOU ACQUIRED IT. IF YOU DOWNLOADED BulletProof Security Pro FROM THE AITPRO WEBSITE, CONTACT AITPRO FOR A REFUND IF APPLICABLE.
″You″ and ″Your″ refer either to an individual person or to a single legal entity.
This Agreement includes Section 1 – General Terms and the AITpro Software Products License and is the complete agreement between You and AITpro regarding the use of BulletProof Security Pro. It replaces any prior oral or written communications between You and AITpro concerning Your use of BulletProof Security Pro. BulletProof Security Pro is owned by AITpro and is licensed, not sold.
AITpro grants You a non-exclusive license to use BulletProof Security Pro when You lawfully acquire it. You may make and install copies of BulletProof Security Pro, including backup copies, to support such use. You may modify the BulletProof Security Pro coding for Your own personal uses and purposes. You may install BulletProof Security Pro on websites, website domains and website hosting accounts that You directly own, You directly support or You directly manage on an ongoing basis. The BulletProof Security Pro license does not have a limitation on the number of websites, website domains and website hosting accounts that You can install BulletProof Security Pro on, as long as these websites, website domains and website hosting accounts are either owned directly by You, supported directly by You or managed directly by You on an ongoing basis. If You install BulletProof Security Pro on Your clients websites then You are responsible for supporting BulletProof Security Pro for Your clients. AITpro offers free technical support to the licensee of the BulletProof Security Pro software only and is not responsible for supporting BulletProof Security Pro on Your clients websites. The terms of this license apply to each copy You make. You agree to keep this original license, unmodified or altered in any way, with the original copy of BulletProof Security Pro that You have and any and all copies or partial copies of BulletProof Security Pro that You make. You will ensure that anyone who uses BulletProof Security Pro (accessed either locally or remotely) does so only for Your authorized use and complies with the terms of this Agreement.
Conditions That Do Not Qualify As “websites supported directly by You or managed directly by You”
1) If You are a Web Hosting service provider or solely providing website hosting services to Your clients or customers this does not qualify as websites supported directly by You or managed directly by You. Supported directly by You or managed directly by You specifically means that You are directly working on, directly maintaining or directly managing any websites that You have installed BulletProof Security on, on an ongoing basis.
2) If You build or design websites for clients or customers as a one time sale agreement and You will not be continuing to directly support or directly manage Your clients or customers websites this does not qualify as websites supported directly by You or managed directly by You. Supported directly by You or managed directly by You specifically means that You are directly working on, directly maintaining or directly managing any websites that You have installed BulletProof Security on, on an ongoing basis.
You may not:
1) use, copy, modify, install or distribute BulletProof Security Pro except as provided in this Agreement;
2) reverse assemble, reverse compile, or otherwise translate BulletProof Security Pro except as specifically permitted by law without the possibility of contractual waiver and as provided in this Agreement; or
3) sublicense, rent, sell or lease BulletProof Security Pro.
AITpro may terminate Your license if You fail to comply with the terms of this Agreement. If AITpro does so, You must destroy all copies of the BulletProof Security Pro software.
Money-back Guarantee
If for any reason You are dissatisfied with BulletProof Security Pro and You are the original licensee, You may obtain a refund of the amount You paid for it, if within 30 days of Your purchase date You return BulletProof Security Pro to AITpro and destroy any copies of the BulletProof Security Pro software. If You obtained a copy of BulletProof Security Pro from another party other than AITpro then AITpro is released from any responsibility of offering a refund. AITpro does not offer a Money-back Guarantee for illegal, stolen or pirated AITpro software.
Software Transfer
You may transfer BulletProof Security Pro and all of Your license rights and obligations to another party only if that party agrees to the terms of this Agreement. When You transfer BulletProof Security Pro, You must also transfer a copy of this Agreement. After the transfer, You may not use BulletProof Security Pro.
Charges
The amount payable for a BulletProof Security Pro license is a one-time charge. When upgrades are available for BulletProof Security Pro You are entitled to upgrades of BulletProof Security Pro at no additional charge.
Limited Warranty
AITpro offers a 60 day Limited Warranty from when AITpro delivers BulletProof Security Pro to You, either via download, direct file transfer or email. AITpro warrants that BulletProof Security Pro will have not have software coding errors within the AITpro software and when used on the correct platform and installed and configured according to the BulletProof Security Pro help documentation. This warranty will be void if You, or anyone else other than AITpro, modifies or attempts to modify BulletProof Security Pro.
Limited Warranty Disclaimer:
The 60 day Limited Warranty as stated above is the only warranty AITpro provides for BulletProof Security Pro. Except for this warranty, all AITpro licensed products and documentation are provided “AS IS”. AITpro disclaims all other warranties (express, implied, or statutory), including any warranties of merchantability, fitness for a particular purpose, title, or non-infringement and any warranties arising from a course of dealing or usage of trade.
Limitation of Liability
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MODIFIES AND/OR CONVEYS BulletProof Security Pro AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE BulletProof Security Pro (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF BulletProof Security Pro TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Interpretation of Limitation of Liability
If the limitation of liability provided above cannot be given local legal effect according to their terms, reviewing courts shall apply local law that most closely approximates an absolute waiver of all civil liability in connection with BulletProof Security Pro, unless a warranty or assumption of liability accompanies a copy of BulletProof Security Pro in return for a fee.
Special Condition: Release of Liability Due to Software Piracy
BulletProof Security Pro is currently only available for purchase directly from AITpro. If you have purchased a copy of BulletProof Security Pro from another party other than directly from AITpro, AITpro is released from all liability. It is a commonly known practice for software pirates and / or hackers to modify software by adding backdoors, adding malicious code or other harmful code and redistribute or resell it to unsuspecting victims. The AITpro guarantee and warranty are void and AITpro is not liable or responsible for any data theft, loss of data or any damages that may result from using illegal, pirated or stolen AITpro software. If you have unknowingly purchased an illegal copy of BulletProof Security Pro and your website has been damaged please contact AITpro and we will assist you in any way we can to restore your website.
